LEGAL GLOBALISTICS: PROBLEM STATEMENT

Abstract
The article deals with the problems of creating a new science – legal globalistics. It is stated that globalist problems and legal globalization require the creation of a global right to solve world-wide modern challenges for humanity. In this regard, not only comparative analysis is required but also the creation of a world global law, which will, of course, be based on the conclusions of comparative legal analysis, however, will cover a wide range of other mechanisms. The article argues that legal globalistics as a science enables not only to carry out a comparative analysis but also to consider futurological aspects of the development of the legal system of individual states and of the whole global law in the future. Consequently, the legal system of the national state is influenced not only by international law, legal systems of other states, but also by the challenges of contemporary world life, indicating a vector of modernity of static development. It is this subject of research that can be 8 Юридичні науки considered and necessary for the practical and scientific search for the modern Ukrainian jurisprudence, and legal globalistics can fulfil such a function. It is also justified that legal globalistics should be widely represented in Ukrainian jurisprudence for one more reason: social reality is changing and a global civil society, which requires the same global regulation, is emerging. In conclusion, the importance of legal globalistics as a legal science is determined. The development of legal globalistics will result in: updating the system of law and the system of legislation through the possibilities of an adequate combination of implemented international and global values of conduct and national-mental legal substances; formation of the state policy and definition with the strategy of development of state-legal paradigms; legal sphere’s understanding of the latest trends and innovative mechanisms; positive impact on civil society and legal consciousness, educational and informational sphere; potential opportunity to draw a boundary between the state and the negative effects of globalization and global problems through the implementation of preventive measures; increase in activity of international cooperation in all spheres of national economy and culture.
