LEGAL PRINCIPLES OF THE SECRECY REGIME IN UKRAINE

Abstract
The article is devoted to the clarification of the principles of legal regulation of the secrecy regime in Ukraine. The mechanism of classification and declassification of information, the procedure for access to classified information, the establishment of liability and other measures are essential for ensuring the strict functioning of the secrecy regime, and therefore require effective and clear legal regulation, elimination of gaps in legislation in the information sphere and the adoption of necessary regulatory acts, which regulates at the appropriate level the relations formed in the field of classified information. The purpose of the article is to study normative acts that form the legal basis for the secrecy regime in domestic law in the retrospective and at the present stage, and to identify the problematic aspects of the legal security of the secrecy regime. It is established that the basic laws, which completely or largely regulate the regime of secrecy, are the following laws: “On State Secrets”, “On Information”, “On Access to Public Information”, “On the Security Service of Ukraine” and others. Of importance, given the practical implementation of the rules of the law in the field of state secrets, are sub-legal acts: decrees, orders, instructions, etc. There are some gaps in the legal regulation of the secrecy regime; the analysis of normative acts, which form the legal basis for the secrecy regime, is carried out, and it is determined which questions regarding the regime of secrecy are the subject of domestic legislative regulation. Also, the problem aspects of the legal regulation of the secrecy regime are defined in the article.
