LEGAL REGULATION OF WORKERS’ HEALTH AND SAFETY FROM ASBESTOS INFLUENCE IN THE EUROPEAN UNION

Abstract
This article is dedicated to legal regulation of workers´ health and safety from negative asbestos influence during the work. The EU directive on this area either provides a protection of workers’ health and safety and, in particular, identifies measures about avoiding unhealthy influence of asbestos and arising of its potential danger during production or clearly regulates employer’s duties on this question. Council Directive 83/477/EEC shall apply to activities in which workers are exposed during the work to dust arising from asbestos or materials containing asbestos. In the case of any activity that can involve the risk of exposure of asbestos dust or materials containing asbestos, this risk must be assessed in a way to determine the nature and degree of the workers’ exposure to dust arising from asbestos or materials containing asbestos. Directive shall prohibit activities which expose workers to asbestos fibres during the extraction of asbestos or the manufacture and processing of asbestos products or the manufacture and processing of products containing intentionally added asbestos.
