Legal status of public associations and individual citizens in the field of Ukranian cultural heritage protection

Abstract
There is a tradition in the world that the main subject in the field of cultural heritage protection is public authorities – state specialized bodies and institutions and bodies of local self-government. At the same time, non-governmental institutions – public associations and some indifferent citizens – are increasingly playing a role in preserving the cultural heritage of mankind. The relevant associations and citizens are quite active in many countries of the world, and their legal status is determined both at the level of national law and is gradually becoming subject to international law. The purpose of the article is to analyze the national legislation that regulates the activities of public associations and individual citizens in the field of cultural heritage protection of Ukraine. The scientific novelty is to identify and analyze the legal support for the activities of public associations and individuals as separate important entities in the field of cultural heritage protection of Ukraine. Conclusions. An analysis of world practice in the field of protection of cultural heritage shows the active involvement of public associations and individual indifferent citizens in this process. Ukraine also has a long tradition of involving the public in conservation activities. The necessary legal basis for such activity was laid back in the Soviet period, and is now guaranteed by the Constitution of Ukraine and norms of both general and special legislation. Among the most powerful public sector organizations, it is worth mentioning the long-standing work of the Ukrainian Society for the Protection of Historic and Cultural Monuments, whose legal status is defined by the Law of Ukraine «On Protection of Cultural Heritage» and its own charter. Among the international non-governmental public organizations operating in our country are the Ukrainian National Committee of the International Council on Monuments and Landmarks and the Ukrainian Committee of the ICOM Council of Museums, which act in accordance with international law and Ukrainian legislation, in particular Law of Ukraine «On Public Associations», as well as its own statutes. In addition, national law gives individuals the right to engage in monumental activities on the rights of public inspectors, to conduct public examinations of cultural heritage sites, to establish patronage over them to ensure their preservation, and so on. On the whole, Ukrainian legislation on ensuring the right of participation of public organizations and individuals in the protection of cultural heritage is in line with basic international norms and widespread foreign practice.
