Cooperation between Ukraine and the OSCE on the protection of human rights to freedom of conscience and religion

Abstract

The purpose of the article is to analyze the basic CSCE/OSCE documents and their influence on domestic legislation in the area of freedom of conscience and religion, as well as the cooperation between our state and the OSCE on the protection of freedom of conscience and religious rights of a human and a citizen. The scientific novelty is to analyze the normative framework of cooperation between Ukraine and the OSCE regarding protection of human rights to freedom of conscience and religion, the compliance of the national legislation of our state with the OSCE principles and recommendations on the protection of the rights of believers, as well as the implementation of bilateral projects that ensure democratic transformations in our state. Conclusions. Ukraine closely cooperates with the OSCE in the field of human rights and citizen protection, including in the area of freedom of conscience and religion. Most of the relevant OSCE recommendations are implemented in national legislation, new legislative changes are being drafted to take into account OSCE recommendations on the rights of believers and religious communities. The legal basis for bilateral cooperation is in addition Memorandum of Understanding between the Government of Ukraine and the Organization for Security and Cooperation in Europe (OSCE) concerning the creation of a new form of cooperation of 13 July, 1999, as well as memorandums on: Mutual understanding between the Ministry of Internal Affairs of Ukraine and The OSCE Office for Democratic Institutions and Human Rights (ODIHR) of 5 July, 2012, Cooperation between the Constitutional Court of Ukraine and the OSCE Project Coordinator in Ukraine of 16 July, 2014, Cooperation between the Supreme Court Ukraine and the OSCE Project Coordinator in Ukraine dated 24 July, 2014. These legal acts became the basis for implementation of the OSCE /ODIHR draft "Strengthening the security of religious communities and other groups in Ukraine" in 2015-2016. A great activity is carried out by the OSCE Project Coordinator in Ukraine and the OSCE Special Monitoring Mission to Ukraine, which collaborates with Human Rights Commissioner of the Verkhovna Rada. Thanks to such intensive cooperation between the OSCE and Ukraine, not only national legislation on the protection of human rights to freedom of conscience and religion is improved, but also judicial practice, which guarantees the democratic transformations in our state.
