Legal technique specific to comparative procedural law in addressing case-based scenarios: The Venezuelan Case

Abstract

This article addresses the legal technique of comparative procedural law applied to case scenarios, emphasizing its practical usefulness in improving judicial systems. Through a reflective review and analysis approach, key concepts such as comparison, reception, transplantation, incorporation, extromission and legal graft, as well as the processes of export, import and harmonization of rights, are examined. This work organizes and synthesizes existing knowledge, identifying patterns and challenges in the modernization of Venezuelan procedural systems, highlighting the implementation of orality and the incorporation of international principles. Additionally, it discusses how these techniques can facilitate mutual learning between jurisdictions, promoting a constructive dialogue that enriches legal practices. This analysis highlights the relevance of comparative law to promote more equitable and efficient justice, without compromising national legal identity, and suggests that international collaboration can be key to facing contemporary challenges in the judicial field
