LIMITATION OF THE RIGHT OF A PERSON TO THE INVIOLABILITY OF HOUSING IN THE SYSTEM OF MEASURES OF CRIMINAL PROCEDURAL COERCION

Abstract
In work restrictions of the right of the person to inviolability of dwelling in system of measures of criminal remedial compulsion are investigated. The notion of “measures that restrict a person’s right to the inviolability of the home” is specified. It is established that such measures should be applied by authorized bodies (officials) in relation to the range of persons defined in the legislation with a view to preventing and suppressing wrongful acts, identifying and consolidating evidence, and also for successfully solving the tasks of criminal proceedings. The content of the category of activities under investigation consists in the temporary restriction of the individual’s abilities to realize the right to inviolability of the home in accordance with the general principles of limiting the rights and freedoms of the individual. It is established that promising areas for further research are the formation and scientific analysis of the list of activities that limit the human right to the inviolability of the home.
