MANDATORY REPRESENTATION AS A GUARANTEE OF COMPETITION IN CRIMINAL PROCEEDINGS

Abstract
The article is devoted to the investigation of the institute of refusing the prosecutor to support the state prosecution. The investigation is carried out from the standpoint of the procedural capacity of the victim to support the prosecution in the event of the prosecutor’s refusal. It is concluded that the most optimal option for protecting the rights and legitimate interests of the victim is the mandatory appointment of a representative. Written refusal of the victim to maintain the charge can be taken by the court only after consultation with the lawyer.
