Mediacja a inne alternatywne formy rozwiązywania sporów na tle spraw rodzinnych – cz. II

Abstract
The second part of the article presents comparison between mediation and negotiation, arbitration, med-arb, arb-med, mini-trial, collaborative divorce and fact-finding in resolving family disputes. It is shown that mediation is often the second step – after a negotiation – in resolving family disputes and needs to be considered when the parties’ emotional state disallows them to resolve a dispute on their own. As to arbitration, it is worth to point out that this method differs greatly from mediation and the main distinction lies within the powers of the mediator and the arbitrator in both proceedings, formalization and the lack of a win--win concept in arbitration. Also, higher costs and legal restrictions (for example art. 1157 of the code of civil procedure excludes alimony cases from arbitration’s jurisdiction) lead to the conclusion that mediation is more suitable for resolving family disputes. Both med-arb and arb-med methods in their various forms can be successfully used in family matters but are usually more expensive than mediation and cannot be applied to alimony cases. They can also be conducted only on the basis of a contract of the parties. Mini-trial is in some aspects similar to evaluative mediation, but it is more costly since it involves the work of lawyers and therefore is used mainly to resolve disputes regarding high amounts, so there is a little chance of using this method in family matters. Collaborative divorce is a new ADR method which applies only to divorce disputes. So far, in Poland there is very little interest in the usage of the method, partially because ruling on divorce lies within the competences of courts and is strictly regulated by the Polish law. Finally, fact-finding could be applied to division of property cases in which expert’s knowledge is needed.
