Kompetencja sądu arbitrażowego do zadania pytania prejudycjalnego

Abstract

Preliminary ruling is described as the most effective mechanism of constitutionalization of the European law. Under Article 267 TFEU, the court or the tribunal, before which such a question of interpretation of the Treaties is raised, may request the Court to give a ruling, if it considers that a decision on the question is necessary to enable it to give judgment. Arbitral tribunals do not qualify as court or tribunal of a Member State and thus it is unable to refer a questions to the CJEU on interpretation of the EU law. On the other hand, arbitrators have to be aware that their interpretation of applicable EU law will be reviewed by a competent court of a Member State. According to the CJEU, an arbitration tribunal have a possibility to initiate an indirect request to the CJEU via national courts. The author will discuss the scope of arbitral tribunals to request an indirect preliminary reference to the CJEU through a state court, particularly in jurisdictions which have a specific provision. Notwithstanding the foregoing, the author of the article will also consider whether the CJEU accepts an indirect preliminary ruling.
