Od ugody pretorskiej po urzędy pośrednictwa – przedsądowe i pozasądowe metody rozwiązywania sporów cywilnych w prawie austriackim

Abstract

The aim of the present study is to depict a regulation of conciliatory methods of dispute resolution in Austrian civil law since the 19th century. Therefore, on a wide historical background and in connection with a German legal tradition, there is a description of an evolution of the approach to out-of-court methods in Austria. Furthermore, the study shows a connection of the evolution to deep political changes in Austria (constitution of 1867) and creation of a modern civil procedure code in 1895. The author especially concentrates on a legal basis of two institutions: municipal mediation offices (Gemeindevermittlungsämter) and a settlement before the District Court (prätorischer Vergleich), comparing the latter with a Polish regulation of that issue. Such review leads to a final conclusion about a role which Austrian legislation may in the future play in regard to Polish legislator and their projects.
