Abstract
Performance of the function of an arbitrator in a court of arbitration comes with a range of duties that can, in practice, be performed improperly or even not at all. Failure by the arbitrator to exercise due diligence in the performance of his duties related to the arbitration proceedings may lead to arbitrator’s liability in various ways. The arbitrator's liability may consist in loss of his mandate, liability for damages, and in the case of permanent arbitration courts also disciplinary liability. The subject of this work is to discuss the problem of the arbitrator's liability for damages, which affects not only his legal situation, but also how the arbitration is perceived in the society.
