The 2012 Revision of the Swiss Rules
Journal Title: ADR. Arbitraż i Mediacja - Year 2015, Vol 1, Issue 29
Abstract
The new Swiss Rules came into force on 1 June 2012 and apply to all arbitrations initiated after this date. The new Rules are available online in 10 different languages . The first Swiss Rules only came into force in 2004. Before this time, the chambers of commerce in Switzerland maintained separate rules. The Swiss Rules of 2004 were well designed and did not require a true overhaul in 2012. Nevertheless, the revision of the UNCITRAL Rules and the ICC Rules represented a perfect opportunity to review the Swiss Rules as well. The Swiss Rules are still modern, decentralized and inclusive, nonetheless some substantive but relatively subtle alterations mark the 2012 Swiss Rules . My task on this panel is to tell you about these changes in the Swiss Rules. Due to the short time available for this section of the presentation, I will only refer to the most important alternations, and refer you to a table of all changes provided by the Swiss Chambers’ Arbitration Institution .
