Mediation and facilitation as extrajudicial means of resolving disputes: concepts and their differences

Abstract
The article outlines the essence of the processes of mediation and facilitation as alternative (out-of-court) means of resolv- ing disputes. The relevant aspects that have become the reason for the demand of such specialists as mediators and facilitators in resolving conflicts that arise between the parties to the dispute are indicated. The concept and the main signs of mediation and facilitation have been investigated. A comparative analysis of mediation and facilitation was carried out, during which the main differences between these concepts were identified. The foreign experience of using mediation and facilitation in practice, as well as general statistical data on the effectiveness of mediators and facilitators in different countries of the world, is researched.
