Abstract
The aim of this article is to discuss issues related the management of space by municipalities through the enactment of local development plans. They affect the ownership rights and shape the manner of exercising the right of property. Conducting an effective spatial planning policy, based on the principle of spatial order and sustainable development, very often leads to violations of the interests of private property owners by limiting the way the performance of their ownership rights. The ideas contained in this article aimed to show properly understood power planning that is not unlimited and legal mechanisms to compensate the owner of the property damage sustained as a result of the activity of planning the municipality together with the assessment of these regulations in the context of adequate protection of ownership rights.
