Modern model of the protection of fundamental rights in the European Union.

Abstract
Проаналізовано еволюцію статусу Хартії ЄС про основоположні права від політичної декларації до правового інструменту інтеграції, сучасну практику застосування Хартії ЄС 2007 р., а також особливості внесення змін до неї. Зауважено, що визнання Хартії ЄС 2007 р. частиною первинного права ЄС не означає поширення на неї прямої дії, що разом із приматом права ЄС є засадничими для функціонування інтеграційного правопорядку ЄС. Наголошено на нетрадиційному підході до класифікації основоположних прав у Хартії ЄС 2007 р., а також висвітлено категорії основоположних прав, підтверджених у ній. Зазначено, що Хартія ЄС 2007 р. надає особам права щодо інституцій, органів та агенцій ЄС, а також щодо держав-членів, коли вони діють у межах сфери застосування права ЄС. Підсумовано, що Хартія ЄС 2007 р. суттєво вплинула на забезпечення демократичної легітимності правопорядку ЄС, інтегральною складовою якого є правові гарантії захисту основоположних прав на рівні ЄС.
