Надання адміністративних послуг як функція органів місцевого самоврядування

Abstract

The article analyzes and investigates one of the most important areas of work of local self-government in Ukraine - providing administrative services to residents of the respective territorial community. Creating convenient and accessible conditions for obtaining administrative services is one of the main tasks that should be solved by local self-government bodies. After all, the main purpose of the public administration - the provision of services, and the quality of services, each citizen evaluates the competence and goodwill of the authorities. It is important that many measures to improve the quality of administrative services can be implemented on their own initiative by local heads, local deputies, and other officials of local self-government bodies. Mostly, these changes do not require the adoption of new legislation or special support from the central government. This view has in fact been confirmed by the experience of many Ukrainian cities that have made one of the first steps for a new quality of administrative services - have created centers of administrative services provisioned initially, that is, even before the relevant requirements of the Law of Ukraine "On Administrative Services" come into force. The benefits of setting up administrative services are not only in the convenience and accessibility of services for citizens and business. Positives for politicians and employees are no less important. These include: - satisfied citizens (voters); - orderly working conditions of the personnel; - rational decision-making procedures; - Minimizing the conditions for corruption and abuse; - Improved investment climate. The basis of the idea of a service state and the doctrine of administrative services is the concept of serving a state to a person / citizen. Since the late 80s of the last century, many developed countries, in particular, the United Kingdom, the United States, Canada, the Netherlands, Sweden, Finland, have begun to introduce customer-oriented models of citizen servicing, that is, the organization of work of public authorities with citizens on the principles of the private sector. The essence of these changes is to reorient the brisk bureaucratic car to a more flexible, more friendly system of servicing citizens. At the same time, they began to use the assessment of the work of the authorities, based on expectations and preferences of consumers. Among the criteria for assessing the quality of public (including administrative) services, the following are distinguished: efficiency, timeliness, professionalism, competence, affability, convenience. At the same time, the category of "services" in the public, including the municipal sector, has the same load as in the private sector on the basis of it - it is activity to meet the particular needs of the person, which is carried out mainly on the application of this person. The official definition of "administrative service" is provided in the Law of Ukraine "On Administrative Services" dated September 6, 2012. In particular, according to this Law, an administrative service is a "result of the exercise of power by the subject of the provision of administrative services on the application of a natural or legal person, aimed at acquiring, changing or terminating the rights and / or duties of such person in accordance with the law". In our view, in Ukraine, in the organization of providing administrative services, it is advisable to choose the path of Poland, Germany and other decentralized countries large in size and population. The best alternative commercialization is decentralization. Then the question of the quality of services will be the responsibility of local self-government bodies. And Ukraine already has something to be proud of, because many Ukrainian cities already offer quite high quality services. Apparently, in a decentralized way, administrative services will be of different quality in different communities. Local corruption may also appear somewhere. But firstly, it will become an exception rather than a centralized practice. Secondly, with proper institutional separation, the executive will be able to more effectively control the legitimacy of local self-government. Therefore, for the success of the reform of administrative services, including in the municipal sector, a clear definition of the parameters of the state policy and the sequence of its implementation are needed.
