ПРО ПРИРОДУ АДМІНІСТРАТИВНО-ПРАВОВОГО СПОРУ У КОНТЕКСТІ ОСКАРЖЕННЯ РІШЕНЬ, ДІЙ АБО БЕЗДІЯЛЬНОСТІ СУБ’ЄКТІВ ВЛАДНИХ ПОВНОВАЖЕНЬ

Abstract
The article examines the nature of an administrative dispute, which allows to distinguish the differences between appeals in administrative law and other areas of law. The definition of an administrative dispute is being formed through solving two interrelated problems: determining the essence of the administrative dispute as a legal phenomenon, as well as determining the criteria for distinguishing this type of legal disputes from other types of disputes. The paper established logical connection and relationship between administrative dispute and legal conflict. There are four distinctive features of a legal conflict: a) the presence of actors in a conflict that has the status of public officials; b) the opposition of these actors, which means that they have positions incompatible with each other and seek inconsistent goals; c) the activity of participants in the conflict, that is, the presence of inconsistent positions or goals; d) an important role of the conflict situation. It is emphasized on the existence of non-conflict disputes. The difference between dispute-conflict and dispute-discussion is determined. It is noted that the dispute-conflict, in contrast to the dispute-discussion, arises in a situation where one actor makes a possible or actual violation of the rights, freedoms, legitimate interests of another actor and therefore law regulation is focused mainly on establishing procedures for resolving those legal disputes that are of a conflicting nature. The dispute-discussion has a non-conflict character, because the actors of the dispute have opposite positions, but one goal, which makes it possible to reconcile their positions. It is indicated that the administrative dispute belongs to public disputes along with constitutional and procedural disputes, which has a number of common characteristics: a) they arise in public relations and characterized by inequality, regulated by the imperative method and based on a public interest; b) one of the actors of a public dispute is the owner of public authority - a public official; c) this actor has to exercise his powers in the relations on the basis of which the dispute arose; d) the actors of this dispute have specific ways of protecting their rights; e) public disputes are resolved in a special order and using specific procedural forms that differ from the order and forms of resolution of private disputes. The criteria are studied (sphere of relations, subject structure and forms of activity of actors, actors of dispute resolution, nature of relations and stated requirements, etc.) which allow not only to differentiate between public and private disputes, but also to differentiate within each of these groups. The author offers the definition of the administrative dispute, which enables to solve not only scientific problems, but also a more balanced approach to a number of practical problems. in particular, the definition of the jurisdiction of the resolution of certain groups of disputes (especially, on the verge of constitutional and administrative law, administrative law and commercial legislation).
