НАПРЯМИ ОПТИМІЗАЦІЇ ПРАВОВОГО РЕГУЛЮВАННЯ ПЕНСІЙНОГО ЗАБЕЗПЕЧЕННЯ

Abstract
The article analyzes the directions of optimization of legal regulation of pension provision. The existing problems of legal regulation are highlighted. The ways of solving such problems are proposed and the corresponding proposals for changes in the normative legal acts of Ukraine are formulated. The attention was drawn to a large number of legislative problems pointed out by domestic researchers in recent years and relevant at present, namely demographic problems, problems of the budget deficit and the Pension Fund of Ukraine, problems associated with the war and the state of the economy (in particular, its shadow parts), etc. The division of the problems of legal regulation of pensions into two groups is proposed: general problems of legal regulation of pensions and problems of the functioning of separate levels of the pension system, in particular the accumulative system of compulsory state pension insurance and non-state pension provision. Thus, to the general problems of the legal regulation of pension provision, let us consider the following: a) the severity of the pension system, which complicates understanding of the pension system for ordinary citizens; b) provision of benefits in the provision of pensions to certain categories of citizens (the existence of special pensions); c) linking the size of the pension by age to the subsistence level, which is not consistent with the growth of wages, the actual financial capacity of the Pension Fund and insurance contributions during the employment activity. It is concluded that solving the problems of pension provision is possible by combining the norms of all normative legal acts that regulate the functioning of the pension system of Ukraine, solving the problems of granting benefits in pension provision to certain categories of citizens, establishing a fairer amount of minimum and maximum pensions, facilitating understanding citizens of the essence of the current pension system of Ukraine.
