NON JURISDICTIONAL MEANS OF ADJUSTMENT AND SOLVING LEGAL DISPUTE IN UKRAINE

Abstract
This article is devoted to the analysis of out of jurisdiction means of settling and resolving legal disputes in Ukraine. These are institutions that have tools for settling and resolving legal disputes, but are not public authorities or acting on behalf of the state. In Ukraine, there are two types of out of jurisdiction and disjunctive dispute resolution and resolution bodies: those preserved from the Soviet period and those that are the property of world legal practice and borrowed from other countries. The first ones include arbitration courts and labor disputes commissions (LDC). LDC is a mandatory primary body for the settlement and resolution of labor disputes for a certain category of employees in certain cases as a first instance. Consequently, the LDC is not a voluntary jurisdiction. Arbitral tribunals are not part of the system of general proceedings. The dispute may be referred to the arbitral tribunal exclusively on a voluntary basis in the presence of the parties to the arbitration agreement, and arbitral tribunals may be permanent and created to resolve a particular dispute. The arbitral tribunals and the LDC are not, however, jurisdictional but have normative competence in the field of the protection of rights. The second group includes tools that are being gradually introduced for settling disputes: Alternative Dispute Settlement (ADS): Mediation, Negotiation and Facilitation. None of these dispute resolution and settlement tools is legitimized in Ukraine. In this case, the mediation procedure, for example, has been actively implemented in Ukraine’s legal practice in recent years. The technique of negotiations is actually also used in legal activities. The practice of lawyer-practice is related to the implementation of negotiations, especially in the area of preventing disputes and pre-trial phase of their settlement. Negotiations are an integral part of the work of most representatives of legal professions in Ukraine.
