НОРМАТИВНО-ПРАВОВЕ ЗАБЕЗПЕЧЕННЯ АДМІНІСТРАТИВНОЇ ПРОЦЕДУРИ РЕАЛІЗАЦІЇ АРЕШТОВАНОГО НЕРУХОМОГО МАЙНА ЧЕРЕЗ ЕЛЕКТРОННІ ТОРГИ

Abstract
The article describes the legal and regulatory framework of the administrative procedure for the realization of arrested real estate through electronic trades. The analysis of the sources of administrative law and the provisions of the legislation on the realization of arrested immovable property through electronic bidding allowed us to conclude that the legal basis for the said activity is presented as general and special rules on enforcement proceedings. It is determined that the basic provisions, which confirm the proper implementation of the implementation of the arrested immovable property, are enshrined in the Constitution of Ukraine and must be observed in the conduct of public administration activities. International acts were identified as yet another direct legal source of the mechanism for the realization of arrested immovable property. The basic laws and subordinate acts, which are guided by the state executors at realization of the arrested real estate by electronic auction are outlined. Judicial decisions are identified as yet another instrument in the regulation of activities for the implementation of arrested property in the enforcement proceedings. The process of updating the legislative framework of the investigated sphere has been analyzed, which in turn has made it possible to understand the process of establishing a mechanism for the realization of arrested real estate by electronic auction.
