НОРМАТИВНО-ПРАВОВЕ ЗАБЕЗПЕЧЕННЯ ПРОЦЕСУ ДЕЦЕНТРАЛІЗАЦІЇ В УКРАЇНІ

Abstract
Problem formulation. Improving and reforming Ukraine’s system of public administration and local selfgovernment based on decentralization of power is deemed as an important condition for Ukraine’s European integration. During 2014 - early 2017 a significant number of regulatory acts for regulating the formation of capable territorial communities were enacted, and the division of powers between executive bodies and local self-government bodies was optimized. Notwithstanding, a number of issues important for the reform to be effectively implemented require legal regulation. Therefore, the regulatory and legal support for decentralization in Ukraine needs a thorough scientific study. Research findings. The study determines and describes four key directions of legislative support for implementing the decentralization of public authority in Ukraine. The main subordinate legal acts of the decentralization are analyzed and their implementation shortcomings are identified. Some issues related to improving the legal regulation and reforming the territorial organization of power in Ukraine have been distinguished. Conclusion. The research has highlighted the key problems in normative and legal support for decentralization in Ukraine. It has revealed that in our state to effectively implement decentralization will need to promptly amend the Basic Law, primarily in respect of the system of administrative and territorial organization and local selfgovernment. The applicable law also needs to be improved and a series of new laws of Ukraine (On administrative and territorial system, On local referendum, On municipal police, etc.) are to be enacted. The analysis of subordinate legal acts on the decentralization of state power in Ukraine has demonstrated their declarative nature, and therefore they require further improvement and a schedule for their implementation.
