NORMATYWNO-PRAWNA REGULACJA UCZESTNICTWA BIEGŁEGO W POSTĘPOWANIU KARNYM UKRAINY I POLSKI: BADANIE PORÓWNAWCZE

Abstract
This article forms part of the series of research on the functioning of the institution of forensic scientists, experts in the criminal justice system. This scientific work contains the comprehensive analysis of the legal regulation of experts’ participation procedure in the criminal proceedings in accordance with Polish and Ukrainian law. In general, it has been proven that the law both of countries is similar in this field. The four groups of legal norms are presented including norms that have equivalents; norms that are partly presented in the legal systems of both countries; norms that do not have equivalents and are used only in the Polish or only in the Ukrainian criminal proceeding. The research results are the basis for critically evaluation of the reforms in Ukrainian justice system and also will have play an important role in determining future direction of optimizing the functioning of the experts institution in criminal proceedings.
