НОВЕЛИ ЗАКОНОДАВСТВА УКРАЇНИ ЩОДО ПРОТИДІЇ ДОМАШНЬОМУ НАСИЛЬСТВУ

Abstract
The article is devoted to the study of Ukrainian legislation on combating domestic violence. The normative legal acts of various legal force of both world and domestic legislation in the sphere of counteracting domestic violence, starting from the Constitution of Ukraine, decisions of the Constitutional Court of Ukraine, sources of international law and decisions of the European Court of Human Rights, codified normative acts and Laws of Ukraine, decrees and by the instructions of the President of Ukraine, resolutions and orders of the Cabinet of Ministers of Ukraine, departmental and interdepartmental acts of executive bodies, Decisions of the Plenum of the Supreme Court of Ukraine and the Plenary Session of the Supreme Specialized Court of Ukraine for the consideration of civil and criminal cases, and ending with sources of explanatory and recommendatory character. The article highlights some of the gaps that exist in the legal field of our state concerning the combating of domestic violence and the ways of overcoming them. The peculiarities of the issuance of an urgent injunction by authorized police officers (police district police officer, patrol police officer or juvenile offender) are discussed. Detailed consideration is given to special measures to combat domestic violence, in particular: an urgent prohibition on the offender; restrictive prescription for the offender; taking on the preventive account of the offender and carrying out preventive work with him; Referral of the abuser to the program for the offender. An urgent prohibitive order is given to the offender by authorized departments of the bodies of the National Police of Ukraine in the event of a direct threat to the life or health of the injured person for the purpose of the immediate cessation of domestic violence, prevention of its continuation or re-offending. An urgent prohibition may include such measures as an obligation to leave the place of residence of a victim; prohibition on entering and staying at the place of residence (stay) of the victim; prohibition in any way to contact the injured person.
