On the issue of introduction of criminal procedural legislation of Ukraine institute of counter charges

Abstract
In the article deals about the possibility and necessity of revival of recrimination institute in the criminal procedural legislation of Ukraine. The article provides a historical and comparative legal analysis of this institution and considers the issues that are associated with the analogue of this institution (counterclaim) in civil and commercial litigation. We also present the point of view of scientists in the field of criminal law on the possible allocation of the concept of the “mutual fault”.
