ORGANIZATIONAL FORMS OF INNOVATIVE ACTIVITY

Abstract
Relevance of the problem. The economic development of any state depends on the state of innovation activity, since it is innovation that constitutes the main factor of the welfare dynamics. To date, in Ukraine, at the level of legislation, a mechanism is being built which is capable of embracing and regulating innovative relations that would combine scientific, research and technology activities, as well as the activities on innovation in a single process aimed at the emergence of a market for innovative assets. Therefore, the legal science faces the task of inventing those organizational forms and legal mechanisms that will create an effective innovation climate in the state. Target of research. The author’s aim is to analyze the organizational forms of innovation activity and to ascertain the effectiveness of the legislative regulation thereof. Analysis of recent researches and publications. In the scientific literature, the problem of organizational forms of innovation activity has not been properly addressed, though some of these forms were studied by such Ukrainian scholars as: S. Hlibko, A. Zelisko, O. Kurchenko, S. Paraska, A. Peresada, O. Romanovskyi, I. Tatomyr, L. Shevchenko, V. Cherniuk and others. Given this, studying the problems of the essential understanding of organizational forms in which actors in the field of innovation can function, will allow at the theoretical level to update approaches to structural elements and determinants that will ensure their simulation. Article’s main body. Traditionally, an innovative system of the state is regarded as a complex of institutions of legal, financial and social nature, which provides innovative processes, and the innovation process as a set of scientific technological and organizational changes that take place in the process of innovation. But the fact that this process can be implemented both in linear and in a chain model affects those organizational forms through which the innovations are embodied. Among the subjects of innovation activities there are innovative structures that carry out innovation activities, having a certain range of innovative features. The most common type of innovation structure – an innovative enterprise that can function in different forms. It is concluded that no matter what names the participants of the innovation process are given, their significance for the purposes of legal regulation should be related to legal capacity. Analysis of the problem of the expediency of developing and implementing innovations in one manufacture leads to the conclusion that in practice, having borrowed the experience of organizing innovation processes in other countries of the world, as a solution to this problem, it is proposed to apply innovations that have already been created outside the specific economic entity by concluding between the interested subjects the innovative contracts, in particular, technology transfer agreements; technological cooperation by joining the efforts of subjects in innovative development (technological parks, technopolises); creation of new innovative companies. In particular, there is a process of academic separation of university structures and the formation of spin-offs based on them («spin-off» and «spin-out»). Among the small organizational forms of innovation activity the startup of the company is considered. Conclusions and prospects for the development. At the level of legislation, a broad approach has been established to implement those organizational forms that are capable of ensuring the interaction between different actors of innovation activity. The organizational form of innovation activity is an internally-organized combination of forces and means by which the aim of the innovation project is achieved. Participants in innovation activities may be subjects of law, and such universal legal forms and models, such as a legal entity, a civil law contract, representation etc. allow them to participate in innovative relationships.
