Abstract

The article deals with the main directions of the state policy in higher education. Organizational and legal mechanism for the state regulation of higher education transformations can be defined as a system of interrelated legal means and structural and organizational tools which contribute to the regulation of social relations between subjects and objects of regulatory influence within social and economic changes aimed at transformation of higher education. Mechanism for organizational and legal ensuring of higher education transformation is based on the set of such definitions as functions and competence of regulatory subjects (sphere of control, rights and duties), forms of activities, forms of responsibility and control, guarantees of activities. Modern legal mechanism for the system of regulation of higher education is a set of international documents, obligations of Ukraine, Constitution of Ukraine, laws of Ukraine, bylaws and individual acts which aim at regulating legal relations between the subjects of educational activity during the influence on educational sphere. Organizational mechanism for regulation of higher education is a consequent and reasonable set of organizational, systematic, administrative and informational aspects. Peculiarities of organizational and legal mechanism for the state regulation of higher education transformation is an independent development and innovation activity which is underlined in the Law of Ukraine ‘On Higher Education’. It is full autonomy of higher educational establishments, their right to dispose of funds independently, freedom in development of strategies and approaches. Legal principles of design of higher education in Ukraine prove that the role of the state tends to increase constantly. It is obvious that depending on certain conditions goals and principles of implementing state educational policy, methods and means of their achievement. It should be taken into account while developing strategic priorities for modernization of the system of higher education in accordance with the needs of informational society.
