Особливості захисту права на рівний доступ до державної служби у контексті європейської інтеграції України / Features of protection of the Right to Equal Access to State Service in the Context of European Integration of Ukraine

Abstract
The author of the article studies the protection of the right to equal access to the state service as one of the fundamental principles of state service, proclaimed both in the Constitution of Ukraine and in the legislation on state service. Attention is drawn to the peculiarities of the formation of the civil service institute and the legal framework for ensuring the right of access to the civil service under the legislation of Ukraine. The essence and content of the concept of «discrimination» are determined. The national and international sources of law regulating the issues of discrimination are researched. Features of the concept of «equal access to state service» are singled out. The author studies “protected features” as individual characteristics, which should not be taken into account for the purposes of the different attitude or the use of a particular good. The concept of «an integral requirement for a profession» is considered; and the limits of its application in accordance with the legislation on state service of Ukraine are determined.
