Особливості cтруктури адміністративно-правових відносин у сфері забезпечення публічної безпеки / Peculiarities of Administrative Legal Relations in the Sphere of Public Safety

Abstract
The article provides theoretical and legal analysis as well as etymological nature of administrative legal relations’ nature. Administrative legal relations in the sphere of public safety in Ukraine have been defined as social relations regulated by administrative legal norms which arise out of authorities in the sphere of maintenance of public order and ensuring public safety when one of the subjects who ensure public safety has managerial authorities. It has been stated that for peculiarities of administrative legal relations in the sphere of public safety in Ukraine general special features of these relations have to be investigated and established focusing on the inherent elements which are subject, object, content and legal fact. Attention has been drawn that an object of administrative legal relations in the sphere of public safety is behavior of the subject ensuring public safety represented by an act or omission to act regarding identification of procedure for informational, personnel, financial, scientific and technological ensuring of public safety as well as enactment of normative and individual legal acts, conclusion of administrative agreements and carrying out of other legally important activities on ensuring of public safety. It has been established that there are many subjects who ensure public safety in Ukraine. In this regard, the best way to classify them according to functions they fulfill, i.e. the ones who have the main function to ensure safety and the ones who ensure public safety indirectly. The first group contain the National Police and other law enforcement agencies, executive agencies, which fulfill organizational, administrative and managerial functions of public safety. The second group includes citizens and non-governmental organizations because fulfillment of the function of public safety will depend only on the will of the person and possibility to exercise provided rights.
