Створення злочинної організації: стан виявлення кримінального правопорушення / Establishment of a Criminal Organization: Status of Revealing of a Criminal Offense

Abstract
The article deals with statistical indicators that characterize the results of criminal organizations revealed by law enforcement agencies of Ukraine for the period 2014 – 2017. In order to investigate the problems that arise when registering crimes under Article 255 of the Criminal Code of Ukraine, the author sent inquiries to regional prosecutors. The results were compared with official statistics. Analyzing the indicators of the regional prosecutor's offices, the author concludes that there is an increasing number of accountable crimes under Article 255 of the Criminal Code of Ukraine and the number of revealed persons. The decline in statistical indicators is cyclical, every two years, so this situation is associated with a high level of latency in this type of crime, rather than a decrease in the level of crime in the country. When considering the figures of official reports and comparing them with the information received from the regional prosecutor's offices, the author comes to the conclusion that there is a big difference between the data under investigation both in terms of terminology and quantitative indicators. The article also highlights one of the important indicators that characterizes the work of law enforcement and judicial authorities - an indicator of the level of conviction. A good illustration of the effectiveness of the fight against criminal organizations is the comparison of data obtained from the State Judicial Administration of Ukraine regarding the number of convicted persons and the number of identified persons in the official reports of the General Prosecutor's Office of Ukraine. A small percentage of convicted persons indicates the inability of law enforcement authorities to adequately and effectively combat such a manifestation of organized crime. In order to effectively combat the creation of criminal organizations, in the conclusion, the author proposes to improve the training of personnel to prevent the commission of crimes on the example of the activities of the United Nations institutes and to improve the methods of collecting and processing statistical information, which today is only a way of displaying obvious cases of committing a crime stipulated by Article 255 of the Criminal Code of Ukraine.
