Abstract
Nesterenko H.B. Particularities of formation and storage of the data, obtained in the process of performance of technical inventory of real estate objects. Not only public enterprises, i.e. bureaus of technical inventory (hereinafter BTI), but also other business subjects, whose activity is regulated by the Instruction about the order of technical inventory, operate at the market of technical inventory of real estate objects. Nowadays, the Instruction is the only regulatory document for performance of technical inventory of real estate objects in Ukraine, which clearly states that an inventory file should be opened for each real estate object and primary inventory of the object should be performed. At the end of March, the Ministry of Regional Development and Construction of Ukraine promulgated the updated project of the Instruction about the order of performance of technical inventory of real estate objects. The Document should substitute the valid Instruction as in force in 2001, which needs substantial reconsideration according to the Ministry’s opinion. Making argumentation concerning improvement of the acting procedure of inventory, authors of the Project first stress improvement of quality and expediting of such service. However, the new reissue of the Instruction aims to simplify control for availability and technical conditions of real estate objects by power authorities, as well as to collect statistical reports and to fight against abuse by real estate owners. Thus, nowadays inventory files are formed and maintained for each object of real estate for the whole period of their existence and should be kept by the authority of state registration according to location of such objects. However, the authorities of state registration do not accept the inventory files because of absence of the order of their transition. Consequently, the inventory files are kept by owners of the real estate objects. Such situation does not only prevent controlling for availability and technical conditions of real estate objects, but also gives the opportunity to make double inventory files and technical data reports. In the modified project, the authors reduced list of the objects, being subjected to technical inventory. There are inventory files and data reports of the objects, which mark that technical inventory should be performed only at the objects with the approved right for construction works on them. A prohibition to issue a data report for the object of self-willed building, make it impossible or, minimum, substantially complicates the procedure of acknowledgement of the property right to self-willing building of real estate objects by juridical decision, and the further taking of such object into operation. Data about real estate objects, set in the process of technical inventory, make a constituent of the State register of property rights to real estate objects, which is an element of the National archive fund. However, that important aspect of the system of state registration of rights to real estate objects is a problem because, at the state level, there is not an integrated concept of reforming of the system of technical inventory of real estate objects. Thus, the issue of performance of technical inventory, completing and maintaining of inventory files should be regulated only by the Law of Ukraine, particularly the Law of Ukraine “About the state registration of property rights to real estate objects and their encumbrances”, or it is necessary to pass the Law “About technical inventory of real estate objects”.
