PECULIARITIES OF IMPLEMENTATION IN THE ADMINISTRATIVE PROCEEDINGS OF UKRAINE OF EUROPEAN STANDARDS IN THE FIELD OF THE RIGHT TO FREE ELECTIONS

Abstract
The article is devoted to the study of the peculiarities of the implementation in the administrative proceedings of Ukraine of standards in the field of the right to free elections formed in the practice of the European court of human rights under Article 3 of the First Protocol of the Convention for the Protection of Human Rights and Fundamental Freedoms. The author analyzes standards that relate to the provision of subjective electoral rights, namely, the right to elect and be elected, the standards for holding free elections and the interpretation of the concept of «legislative body». The article attempts to extrapolate the legal positions of the European Court of Human Rights in this area to administrative proceedings in order to give recommendations to ukrainian administrative courts to use these standards in the process of resolving administrative disputes.
