Pharmaceutical law and implementation of the United Nations Single convention on narcotic drugs of 1961 in the Republic of Tajikistan

Abstract

After gaining independence in 1991 the Republic of Tajikistan has encountered a whole number of social, economic and political problems, illicit trafficking of narcotic drugs represents the greatest danger among them that leads to respective legal, medical and social implications. Subject to the existing situation the Government of the Republic of Tajikistan has elaborated the own antidrug policy. Ratification of the United Nations Single Convention on Narcotic Drugs of 1961 by parliament of the country in 1996 has become the first and policy-making step. The purpose of the paper is to analyse the role of pharmaceutical law in implementation of the United Nations Single Convention on Narcotic Drugs of 1961 in the Republic of Tajikistan. The research objects are the normative legal documents of the Republic of Tajikistan on the subject of narcotic drugs control, which have been accepted by the parliament and government, and also by ministries and departments of the country in the context of the United Nations Single Convention on Narcotic Drugs of 1961. The analysis has shown that a number of legislative documents regulated the questions of the legal circulation control of narcotic drugs and providing drug abuse assistance have been accepted in the republic to execute the article 4 of the Single Convention. The controlled substances have been classified depending on application with legitimate aims, and also on the degree of health hazard. The licensing system of activity in the field of legal circulation of narcotic drugs, accounting and prescribed distribution has been created. Import and export of narcotic drugs are controlled by means of preliminary informing and release of permits valid for one occasion; the system of necessities calculation functions. Thus, the legislative base has been created with the purpose of implementation of the United Nations Single Convention on Narcotic Drugs of 1961 in the republic on the basis of pharmaceutical law.
