Поняття крадіжки, поєднаної з проникненням у житло, інше приміщення чи сховище

Abstract
У статті розглядаються основні і суттєві ознаки крадіжки, поєднаної із проникненням у житло, інше приміщення чи сховище. Розкрито поняття «проникнення», «житло», «інше приміщення», «сховище». Дається трактування цих понять. Так, особливістю житла є те, що воно виступає і сховищем, а «іншого приміщення», на відміну від житла та сховища, є властивість мати «відкритий» характер, що виявляється в загальнодозволеному доступі до нього. При тлумаченні «проникнення» звертається увага на його характерні об’єктивні і суб’єктивні ознаки. Робиться висновок, що «проникнення», будучи допоміжним діянням, для ч. 3 ст. 185 КК має вирішальне кваліфікуюче значення, бо виступає ускладненим способом вчинення крадіжки – таємного викрадення чужого майна. Ця кваліфікуюча ознака розширює межі об’єктивної сторони розглядуваного злочину за: характером підготовки та вчинення діяння; тривалістю діяння при існуючому корисному умислі.
