PRACTICAL APPLICATION OF PROVISIONS OF THE ARTICLE 332 OF THE CRIMINAL CODE «FALSIFICATION OF PUBLIC ACTS ”: PROBLEMS AND SOLUTIONS

Abstract
The application of criminal rule of law aimed to prevent and combat falsification of public documents is determined by the professionalism and the correctness of the courts. However, judicial practice is uneven in the application of provisions of the art. 332 Criminal Code of the Republic of Moldova, being characterized by erroneous qualifications, unjustified mo- tivations, ambiguous findings etc. In this way, this article aims the analysis of practical cases regarding the falsification of public acts, in order to determine the deficiencies in the qualification of this crime.
