Право на забуття: деякі аспекти теорії і практики / The Right to Oblivion: Some Aspects of Theory and Practice

Abstract
On the basis of the analysis of practical sources and scientific literature, the notion of “the right to oblivion”, its structure and the properties of the right to oblivion are defined. The preconditions for the right to oblivion have been characterized. It has been determined that the right to oblivion is separated from the right to inviolability. Also in the article the peculiarities of its implementation were determined in accordance with the international practice of solving such disputes. The international normative legal acts, ratified by the Rada of Ukraine, regulating social relations concerning the right to oblivion are determined. The main problems of its legal regulation were also found out. Attention was drawn to historical aspects, where the idea of the need to protect personal data was related to the “right to have peace”. This is a European practice on privacy. Definition of “data operators” is given. The Charter of Fundamental Rights of the European Union concerning the realization of the right to oblivion is analyzed. The article contains a description of the Regulation on a Multilateral Approach to the Protection of Personal Data in the European Union, as well as the draft General Data Protection Regulation of the European Commission. The stories in the modern legal system concerning realization of the right to oblivion are determined. The risk of the fact that the right to oblivion may contradict certain fundamental human rights is emphasized.
