Prawo i utopia w „Kodeksie natury” Étienna Gabriela Morelly

Abstract
Zamiarem autora artykułu jest pokazanie związków zachodzących między literaturą a prawem. Przykładem tekstu, który można traktować jako dzieło literackie, a zarazem tekst o charakterze polityczno-prawnym jest Kodeks natury E.-G. Morelly z 1755 roku. Świadczy o tym jego piękno, prostota i szczerość przesłania ideowego. Morelly, podobnie jak wcześniej Rousseau, jest piewcą Natury, nawołującym do życia zgodnego z jej: odwiecznymi, niezmiennymi i doskonałymi prawami. Z drugiej strony pozostaje wierny kartezjańskiej tradycji kultu rozumu i jego potęgi. Kodeks natury traktuje się jako oświeceniową utopię komunizmu państwowego. Życie zgodne z Naturą to życie szczęśliwe. Warunkiem jednak jego osiągnięcia jest zniesienie własności prywatnej w stosunkach społecznych. Kodeks natury jawi się również jako zapowiedź nadchodzących procesów kodyfikacyjnych i ugruntowania idei nowożytnego konstytucjonalizmu.
