PREREQUISITES FOR EXEMPTION FROM SERVING SENTENCES FOR PREGNANT WOMEN AND WOMEN UNDER THE AGE OF THREE, DE LEGE LATA

Abstract
The article is devoted to the premises of the exemption of pregnant women and women who have children in age under three years old from serving punishment according to the Ukrainian legislation. Defined the list of types of punishments from which women can be released because of pregnancy or childbirth, which comprises public work, correctional labor, restriction of freedom and imprisonment for a specified period of time. The content of each type of punishment is disclosed. It is determined that condemnation of a woman to all different kinds of basic punishment except mentioned above de lege lata cannot be the premise of the exemption from serving punishment because of pregnancy or childbirth.
