PREVENTION OF MONGOLIAN LAND DISPUTES

Abstract

It is noted that “Right to submit a petition or a complaint to State bodies and officials. The State bodies and officials shall be obliged to respond to the petitions or complaints of citizens in conformity with law” in the Mongolian Constitution in 1992. Judging from the Justice report for 2015 by the Administrative Court of First Instance, the number of solved administrative cases was 634 in 2014 and 245 of them were land dispute cases. The number of administrative cases in 2015 was 926 and 231 of them were land dispute cases. In other words, one of four administrative cases solved by the Court was land dispute case. The article 70.2.1 in the Judicial Procedure for Administrative Case became the rationale of the 1245 decisions for the cancellation of the illegal decisions made by the administrative bodies and officials. Forty five percent of the total administrative cases could meet to the claims by the applicants. Judging from it, the pre judicial procedure of the administrative case is not enough.
