Problems of temporary protection for an administrative claim in Ukraine

Abstract
The article addresses the issues of applying temporary protection for an administra- tive claim in Ukraine. The author analyses adjudication about temporary protection, notes scientists thoughts about the problems of temporary protection for an adminis- trative claim in Ukraine. Also author shows the importance of temporary protection for an administrative claim in Ukraine based on the example of the application of this institution in Poland. Proposed solutions to the problems of the temporary protection for an administrative claim in Ukraine. An important problem of temporary protection is motivating decisions on provid- ing or refusing to support the temporary protection for an administrative claim in Ukraine. The main criterion for determining the correctness of providing / or not pro- viding the temporary protection for an administrative claim is motivated by court or- der. The court claim should contain a motivation judgment. The motivation of judi- cial decisions is a mechanism for monitoring the implementation of justice. The author proposes to make judges disciplinary responsible by creating a body that would be authorized to implement a disciplinary proceedings against judges, as grounds for disciplinary responsibility for unmotivated court decisions.
