PROBLEMS OF THE PRESERVATION OF PHYSICAL EVIDENCE IN THE INVESTIGATION OF CRIMES AGAINST OBJECTS OF CULTURAL HERITAGE (ON THE EXAMPLE OF THE INVESTIGATION IN RELATION TO PAINTINGS BY CARAVAGGIO «TAKING INTO CUSTODY»)

Abstract
The article is devoted to the preservation of material evidence in the investigation of crimes against objects of cultural heritage (on the example of the investigation and trial of the case of the theft of the Caravaggio painting on July 30, 2008 from the Odessa Museum of Western European and Eastern Art). Imperfection of the legislation regulating the issues of seizure, accounting, preservation and transfer of physical evidence, as well as indifferent attitude to the fate of the object of the cultural heritage of mankind had a detrimental effect on the state of the canvas, which is currently being preserved in an inadequate form. In the article, we propose amendments to some normative acts with a view to preventing similar situations now and in the future.
