PROTECTION OF MARRIAGE AND FAMILY IN POLISH LAW AND INTERNAL LAWS OF CHRISTIAN CHURCHES

Abstract

The problem of protection of marriage and family attracts particular attention both of the state and religious associations. The article demonstrates the scope of this protection in Polish law and juxtaposes it with the protection of these institutions offered by internal laws of selected Christian churches. Polish rules and regulations furnish a broad range of instruments safeguarding these institutions. As far as marriage is concerned, these are primarily norms governing the protection of its durability. These are: specific grounds for divorce, nullification of marriage and determination of its invalidation, divorce proceedings allowing for conciliation, in case conjugal life is likely to be sustained, as well as the institution of separation. The instruments of family protection are: specific provisions of family law, tax law, insurance law, rules of procedure (civil, penal, administrative) and regulations on social assistance and prevention of social pathologies (drug addiction, alcohol addiction and domestic violence). These regulations are intended to safeguard basic family needs and pro vide assistance in emergency or crisis circumstances. Furthermore, oftentimes they provide for cooperation between public authorities, churches and religious associations in securing most fundamental family rights. On the other hand, internal regulations of religious associations protect the conjugal bond by securing its indissolubility; however, when it comes to family protection, the universal law of Christian churches fails to govern it directly. Still, it is guaranteed by the norms of particular laws.
