Protection of the Children in Armed Conflicts (Approaches of International Law and Islamic Law)

Abstract
The inauspicious phenomenon of war violates and threatens all rights of the children including right to life, right to live in the family, right to health, right to progress and right to education. According to the recent reports of the international organizations, forced conscription and direct involvement of the children in the conflicts, killing and disabling them, attack on the schools and hospitals, kidnapping, child sexual exploitation, and depriving them of access to humanitarian reliefs are six cases of violence which are committed against the children in armed conflicts. The present article is an attempt to comparatively study the Islamic approach and international approach to protection of children in armed conflicts in the light of the recent reports. The Islamic law and the international law both have general and special provisions for the protection of children. Children’s interests are protected in the reduction of big and small weapons. چکيده پديده ناميمون جنگ همه حقوق کودکان از جمله حق حيات، حق زندگي در کنار خانواده، حق بهداشت، حق پيشرفت و تحصيل کودکان را نقض و تهديد مي کند. مطابق گزارش هاي جديد مجامع بين المللي، سربازگيري اجباري و مشارکت دادن مستقيم کودکان در درگيري ها، کشتن و نقص عضو ، هجوم به مدارس و بيمارستان ها، ربودن، تجاوز و خشونت جنسي و محروم کردن از دسترسي به کمک هاي انسان دوستانه، شش مورد از خشونت هايي است که در درگيري هاي مسلحانه عليه کودکان اعمال مي شود. مقاله حاضر با ملاحظه گزارش هاي جديد و در يک مطالعه تطبيقي طي سه گفتار، رهيافت هاي بين المللي و اسلامي حمايت از کودکان در مخاصمات مسلحانه را بررسي و تحليل خواهد کرد. حقوق اسلام و حقوق بين الملل هر دو، از کودکان حمايت هاي عام و خاص به عمل مي آورند و بهترين منفعت کودکان و بزرگسالان را بايد در کاستن از تسليحات کوچک و بزرگ جستجو کرد.
