Public control by the activity of the judicial authority in the modern stage

Abstract

The article analyzes public control over the activity of the judiciary at the present stage. The negative consequences of the lack of effective public control are the closeness of the judicial structures and the massive violation of the rights and freedoms of citizens; the fall of authority and the level of public confidence; politicization; inefficient and misuse of budget funds; abuse and corruption as a result of the involvement of judicial bodies in economic activity; unsatisfactory moral and psychological state of employees of these structures; slowdown. Public control is one of the main factors of the development of a fair judicial power on the way of building a democratic and developed society. The scientific elaboration of this issue is due to the fact that one of the functions of the state in ensuring public participation is the involvement of the public, which, in turn, should exercise due control over its institutional structures. That is why the goal is to determine the preconditions and basic approaches to forming the sphere of mutual social agreement between people, to develop a new context of social values, to construct a new structure of joint actions of the subjects of social and public practice, to specify the model of their partnership interaction. The disclosed provisions do not fully address all aspects of public control over the activity of the judiciary at the present stage, therefore, scientific research in this area should be continued.
