RECOGNITION AS ILLEGAL AND CANCELLATION OF LEGAL ACTS OF EMPLOYER AS REMEDY OF LABOR RIGHTS

Abstract

The article investigate problematic aspects of such remedy of labor rights as recognition as illegal and cancellation of legal acts of the employer. It is noted that this method remedy of labor rights should be used separately from such as the reinstatement of the employee, change of wording of dismissal cause. Conclusion that disputes on recognition as illegal and cancellation of acts of employer should in most cases be settled through conciliation procedures. The author considers the shortcomings of current labor legislation and the draft Labor Code of Ukraine in the field, puts forward proposals to address them.
