RECOGNITION OF LABOR CONTRACT INVALIDITY AS THE DEFENSE METHOD: PRACTICE AND THEORETICAL PROBLEMS OF APPLICATION

Abstract

The article deals with clarification of the essence and the possibility of application in labor relations of such a method of protection of rights as the invalidation of an employment contract. The substantive differences between the invalidation of the transaction as a way of protecting labor law and termination of labor relations by termination of an employment contract are substantiated. The reasons for the use of such a method of protection are analyzed. The emphasis is on the peculiarities of the legal consequences of the invalidity of an employment contract.
