REFERENDUM ON BOROUGH LEADER DISMISSAL – OBLIGATORY OR OPTIONAL?

Abstract

For a long time it has been almost uncritically accepted in literature that a local referendum is held obligatorily in all three self-governing units on determining bodies dismissal, and in an administrative district also on a borough leader dismissal and on selftaxation of inhabitants for public purposes. This opinion is fully justified with reference to the dismissal of council/regional council and self-taxation of inhabitants – so in appropriate provisions the legislator explicitly determines these issues to be decided only by means of referendum. On the other hand, as far as the referendum on borough leader dismissal is concerned, doubts may arise about referendum classification. There is no provision in which the legislator points out that supposedly the dismissal of a borough leader could occur exclusively by means of referendum. Because of this the author makes a thorough analysis of a number of provisions on the basis of which she attempts to establish whether the generally accepted assumption about the dismissal of a borough leader only by means of referendum is legitimate and free of any objections.<br/><br/>
