Regulations Central Committee of the Communist Party of the USSR and the Central Committee of the Communist Party Ukrainian SSR in the system of legal sources of Ukrainian SSR post-war period

Abstract

The article is an attempt to outline the main aspects of the definition of the role and place in the sources of law of the Ukrainian SSR of the post-war period regulatory requirements Communist Party of the Soviet Union and the Communist Party of Ukraine in view of the considerable amount of this regulatory requirements, much of which was published in Soviet times and awaits its researchers. The nature, content and validity of the joint acts of the government and Communist Party of the Soviet Union and the Communist Party of Ukraine are investigated. Detailed analysis of the characteristics and legal value of the rules of regulations is done. Analysis of the content of these acts gave reason to believe that they mainly contain primary (abstract) rules of compulsory nature, which are then more specific executive authorities to have adopted bylaws. That is, in fact, these joint decisions were acts of higher legal force along with the laws adopted by the supreme legislative body. For rules and regulations of party is characteristic all characteristic features of the law – they are formally defined general rule, binding, and its performance is guaranteed by coercive power of the state. Found these sources of law (acts of Communist Party of the Soviet Union and the Communist Party of Ukraine) different from normal directives party regulatory nature, contain not only reference but mandatory rules and advice. These sources of law are supreme legal force as compared to laws. Seems appropriate to include the conventional system of sources of law of the Ukrainian SSR post-war period acts of the Central Committee of Communist Party of the Soviet Union and the acts of the Central Committee of Communist Party of Ukraine.
