REQUIREMENTS TO KEY CERTIFICATION CENTERS

Abstract
The article is devoted to the analyses of the Ukrainian legislation on the scope of electronic signatures. Ukraine adopted laws concerning electronic signatures, namely The Law of Ukraine “About electronic digital signatures” and “About electronic documents and electronic flaw of documents” earlier in 2003. Now the lawmakers discuss the new draft of the Law of Ukraine “About the electronic commerce”. However, despite Ukrainian lawmakers’ attempts to regulate this area, the digital signatures did not become a common tool in the scope of private transactions. To understand the reasons it is necessary to analyze, among other reasons, the legal regulations in this sphere. We believe that any development of certain market demands prior creation of corresponding infrastructure based on clear and transparent rules. That infrastructure of digital signatures system includes key certification centers, whose activities provide turnover of digital signatures. So we analyzed the requirements to the key certification centers in Ukraine the relevant requirements of European legislation, namely – Directive 1999/93/EC of the European Parliament and of the Council of 13 December 1999 on a Community framework for electronic signatures. A comparison of the Ukrainian and European legislation has led to the conclusion that the requirements of Ukrainian legislation are not clear and transparent. Moreover, such requirements are excessive and negatively affect the development of key certification system in Ukraine. As a resolution of this situation, we propose to bring Ukrainian legislation into conformity with the provisions of Directive 1999/93/EC. We believe that the simplification of administrative procedures will facilitate the development of the electronic digital signatures market in Ukraine.
