Abstract
Arbitration is certainly not free from defects, which shows the practice of law, often inconsistent and it poses many problems. It was recognized, however, that this formula still works better than the use of courts of general jurisdiction. Another thing is that the powers of arbitration panels are limited and actually come down to determine the rights or lack of rights to the domain, which is not always sufficient from the point of view of the entities involved in the proceedings. As I have shown in this study, arbitration works on several levels. First of all, it is important that matters concerning .pl domains fall under the jurisdiction of the Court of Arbitration for Internet Domains with the Polish Chamber of Information Technology and Telecommunications, the .eu – European body, i.e. the Arbitration Center for .EU Disputes. Moreover, in many cases it is necessary to ask the subordinate body of the World Intellectual Property Organization, which decides each year a number of issues relating to domain.com. In addition, the parties may individually and according to their needs define the rules by which their dispute will be recognized – all principles must be included in the contract. However, most agreements are laconic records and any disputes arising from the contract are subject to arbitration. With this general record, the parties must realize that their freedom is limited and the arbitration proceedings will take place on the basis of provisions of the Code of Civil Procedure. In summary, the institution amicable settlement is certainly useful and functional, but brings a lot of practical problems which are not easy to solve. The multitude of cases regarding domains indicates, however, the need for the existence of such bodies and the continuous improvement of legal solutions in this topic. Because the statistics speak for themselves, from year to year, there is a growing number of "domain” disputes, which are demanding the right of greater precision in the functioning of the bodies responsible for the settlement of these disputes
